Terms and Conditions for Pixel Barks Ltd Web Development and Design Services:
By using the services provided by Pixel Barks Ltd you agree to the following terms and conditions:
Payment: All payments must be made in full or an advance as per payment schedule before the commencement of work. Pixel Barks Ltd will not be liable for any delay in delivery of the work due to non-payment.
Scope of Work: The scope of work will be defined in the initial agreement between Pixel Barks Ltd and the client. Any additional work required beyond the scope of work will be charged at an hourly rate.
Intellectual Property: The client agrees that all intellectual property rights, including but not limited to copyrights, trademarks, patents, and trade secrets, relating to the work produced by Pixel Barks Ltd will belong to Pixel Barks Ltd until payment has been made in full by the client.
Confidentiality: Pixel Barks Ltd agrees to keep all client information confidential and will not disclose any such information to third parties without the express written consent of the client.
Termination: Either party may terminate the agreement at any time with written notice. If the client terminates the agreement, the client will be responsible for paying for any work already completed. No refund of advance payment will be given if work has been initiated.
Liability: PixelBarks will not be liable for any loss or damage incurred by the client, including but not limited to loss of profits, loss of data, or other consequential damages.
Governing Law: The laws of the state in which Pixel Barks Ltd is registered will govern this agreement.
Modification: Pixel Barks Ltd. reserves the right to modify these terms and conditions at any time. Any such modifications will be effective immediately upon posting on the Pixel Barks website.
Entire Agreement: This agreement constitutes the entire agreement between PixelBarks and the client and supersedes all prior agreements, whether written or oral.
